Terms of Service
The
following Terms of Service (TOS) or Terms of Use must be agreed to
and abided by for use of
eEyeElements's services.
Please be aware that
eEyeElements reserves the right to modify
the Terms of Service at any time, and without notice. In addition, the
use of
eEyeElements's service (s) by a subscriber constitutes
an unconditional acceptance of and agreement to
eEyeElements's
TOS.
DESCRIPTION
OF SERVICE
eEyeElements provides
users with access to its services, including sub domain and hosting,
various forums, and blogs. You also understand and agree that the
service may include advertisements and that these advertisements are
necessary for eEyeElements to provide the service.
Subscriber should be aware that
eEyeElements may proactively
change the specified sub-domain and hosting rates and charges from time
to time, with any new rate or changed pricing being exclusively
effective for new subscribers or service plan changes. Subscriber is
aware that rates and offers can change upon service plan modification or
new account subscription and may or may not be available for purchase at
any time in the future. However, existing subscriptions will not be
affected by changed pricing or offers.
MEMBER
ACCOUNT, PASSWORD & SECURITY
You
will receive a password and account designation upon completing the
service's registration process. You are responsible for maintaining
the confidentiality of the password and account and are fully
responsible for all activities that occur under your password or
account. You agree to (a) immediately notify
eEyeElements of
any unauthorized use of your password or account or any other breach of
security, and (b) ensure that you exit from your account at the end of
each session.
eEyeElements will not be liable for any loss or
damage arising from your failure to comply with this section.
CONTENT
REMOVAL
You
acknowledge that
eEyeElements may or may not pre-screen
content, but that
eEyeElements shall
have the right in its sole discretion to pre-screen, refuse, or move any
content that is available via the services.
eEyeElements reserves the right to
refuse, revoke or remove the content (content refers to information,
data, text, documents, software, music, sound, photographs, graphics and
video), logo, link, advertisement for any reason without prior notice or
in the exercise of its sole discretion regarding material which it finds
to be objectionable. This may include, but not be limited to
verbal and/or graphic obscenity, adult (pornographic content), violent,
intolerant, racially biased, denigrating, or sexually oriented content
or materials. This includes national / international security threats,
religious conflict, gender bias, alcoholic beverages, tobacco, gambling,
firearms or illegal information or violation of any international, USA,
India and Nepal laws.
PAYMENT
& FAILURE TO PAY
Establishment
of the service is dependent upon receipt of payment of stated charges by
eEyeElements. Subsequent payments are
due on the anniversary date of the month for that month's service or
whichever is the selected billing cycle.
eEyeElements may temporarily deny or
terminate service upon the failure of the subscriber to pay the charges
when due. Such termination or denial will not relieve the subscriber of
responsibility for the payment of all accrued charges and any collection
fees.
ACCOUNT
CANCELLATION
A subscriber
may cancel his/her account at any time by writing to
eEyeElements.
The cancellation will take effect immediately and the subscriber’s
account will remain active until the end of the subscription. There will
be no refund if the fee has paid by the subscriber.
SUBSCRIBER
ACKNOWLEDGEMENT
Subscriber acknowledges that the service provided is of such a nature
that the service can be interrupted for many reasons other than the
negligence of
eEyeElements
or its host company. Therefore, subscriber agrees
that
eEyeElements
shall not be liable for any damages arising
from such causes beyond the direct and exclusive control of
eEyeElements
or its host company.
TECHNICAL SUPPORT
eEyeElements
provides technical support to its
subscribers. We limit our technical support to our area of expertise and
services we are offering.
DISCLOSURE TO
LAW ENFORCEMENT
The TOS specifically prohibits the use of our services for
illegal activities. Therefore, subscriber agrees that
eEyeElements
may disclose any and all subscriber information including assigned
account history, account use, etc. to any law enforcement agency that
requests such information, provided they posses the proper
court-approved warrant, without consent or notification to the
subscriber. Subscriber must provide
eEyeElements
real and current contact information such as e-mail address, snail mail
address, telephone and fax contacts.
APPLICABLE LAW
This TOS is subject to the governing laws of the State of New
Jersey, USA, Maharashtra, India and Lalitpur, Kathmandu, Nepal.
YOUR
OBLIGATIONS FOR REGISTRATION
In consideration of your use of the service, you represent that you are
of legal age to form a binding contract and are not a person barred from
receiving services under the laws of the United States, India and
Nepal or other applicable jurisdiction.
You also agree to: (a) provide true, accurate, current and complete
information about yourself as prompted by the service's registration.

JURISDICTION
& LEGALITY OF CONTENT
Considering
the global nature of the internet,
you agree to comply with all local rules regarding online conduct and
acceptable content.

(Yahoo!'s domain registration partner, Melbourne IT, is the registrar of
our domains. Our domains registered through Yahoo! are recorded and
managed by Melbourne IT's ICANN -accredited domain registration group.).

Web Hosting and its servers are located in the data center in
Hopkinsville, KY, United States and is maintained in reference to the
protections afforded under local and federal laws. Laws in your country
or jurisdiction may not protect or allow the same kinds of speech or
distribution.

any laws; and cannot be responsible for any violations of such laws,
should you link to this domain, or use, reproduce, or republish the
information contained herein.

OR IP INFRINGEMENT
eEyeElements respects the intellectual property rights of others, and
we ask our users to do the same.

discretion, disable or terminate the accounts of users who may be repeat
infringers. Any of the trademarks, service marks, collective marks,
design rights, personality rights or similar other rights including any
kind of copyrights that are mentioned, used or cited in the articles or

domains websites are the property of their respective owners. Their use
here does not imply that you may use them for any other purpose except
for the same or a similar informational use as contemplated by the
